<p><strong> </strong></p>
<p style="padding-left: 30px;">Comes now Jon B. Terry, as one of the attorneys for the Defendants and would move to<br />
continue the current trial setting of January 4, 2010 and as grounds therefore would aver as<br />
follows:</p>
<p style="padding-left: 30px;">1. This case was set for trial several months ago before certain monumental events occurred<br />
that were beyond the anticipation of the attorneys and the clients.</p>
<p style="padding-left: 30px;">2. Since the setting of this case, one of the two great college football teams in this State has<br />
reached levels on a national scale that have not been enjoyed by any team in this State in 17 years next preceding the date hereof.</p>
<p style="padding-left: 30px;">3. Currently, one of the two great teams in this State are playing for a national championship<br />
and has enjoyed an undefeated season and clinched the SEC Title Game.</p>
<p style="padding-left: 30px;">4. Most of the attorneys representing all of the named Defendants have tickets and reservations to be in Pasadena on the 6th day of January, 2010, which date would conflict with the trial date as travel times and schedules for the game overlap the trial as currently set.</p>
<p style="padding-left: 30px;">5. In fact, the Honorable Jim Lloyd has children that live in the area and is scheduled to be<br />
with them in California to celebrate the game and the Tide s success.</p>
<p style="padding-left: 30px;">6. Attempts to resolve this conflict directly with the Plaintiffs has been unfruitful as the<br />
reply has been that they are for the other great team in this State who did not make the playoffs.<br />
Unfortunately, that response remains short-sighted as they may one day find themselves in the<br />
same position that the Defendant attorneys are in and, unfortunately, the BSC Title Game is no<br />
longer scheduled on January 1st, but has been moved to January 7th.</p>
<p style="padding-left: 30px;">7. In checking with your Honor s Office, it was determined that there are potential quick<br />
dates available during March, the only known conflict being that Jim Lloyd has recently been<br />
elected President of the Birmingham Bar and must attend a conference on March 10-12. Other<br />
than that, the Defendants can be ready to be first out during any available week for trial during the month of February, March, or April and believe that there would be no harm, considering the<br />
magnitude of this event and its impact on this State, and the fact such an event only comes<br />
infrequently during a person s lifetime and is an achievement of such a magnitude that all<br />
involved in this litigation should want everyone to fully participate in this achievement.</p>
<p style="padding-left: 30px;">8. It is also understood that many of the witness involved are trying to acquire tickets to the<br />
game and/or scheduled to be at the game in Pasadena on January 7th and certainly any juror<br />
selected to participate will likely be preoccupied and not able to devote their full attention to the<br />
case before them during the week of January 4, 2010, and therefore, the parties would be<br />
prejudiced by the distraction caused by such a major event of such significant importance to so<br />
many people in this State.</p>
<p style="padding-left: 30px;">9. ROLL TIDE!! ( although my secretary is for the other great team of this State, she feels<br />
that I need to attend this championship game!); and may the Longhorns be defeated.</p>

			<content:encoded><![CDATA[<p>Well I hope you all enjoyed my fake picks last week!  That&#8217;s right, I managed to go 0-5, and not just any 0-5, but 0-5 where I was picking favorites to cover in games they were ABSOLUTELY blown OUT.  For example, I hopped on the Miami bandwagon prior to their 31-7 thrashing at the hands of Virginia Tech, and likewise felt the rising Cal Bears were all set to cover 5 points on the road against the Ducks&#8230;and were then promptly embarrassed 42-3 to the point where I&#8217;m not sure I can ever bet on Cal again.  As a result, I don&#8217;t expect you to bet on my picks this week, but perhaps instead treat them as a sort of&#8230;viewing guide.  Sponsored this week by (admittedly, Pro) <a title="cheerleaders in pillowfights" href="http://youbeenblinded.com/behind-the-scenes-with-the-washington-redskins-cheerleaders/4152" target="_blank">cheerleaders in pillowfights</a>, on to the picks:<span id="more-66"></span></p>

<p>Oklahoma -7 at Miami(FL)</p>
<p>Fool me once, shame on you, fool me twice, as the saying goes, shame on me.  Do I risk being fooled twice by a perhaps more glitz and glam than substance Hurricanes squad?  I think not given Oklahoma, even without QB Sam Bradford, boasts 3 of Todd McShay&#8217;s top 32 draft prospects for the draft of 2010 in DT Gerald McCoy (number 3 overall), RT Trent Williams (8), and TE Jermaine Gresham (30).  Personally, I feel Oklahoma is just a team itching to be overrated when Bradford comes back, if that makes any sense.  They have a history of flopping on their faces in big games&#8230;in the postseason, however, not the regular season.  I like OU here, which boasts a defense superior to the one that shut down QB Jacory Harris and the Hurricanes last weekend.  <strong>SOONERS, -7.</strong></p>
<p><strong>Best of the Rest:</strong></p>
<p>USC -4 at California</p>
<p>Another pretty nice showdown that lost a bit of luster over the last two weeks, this one with USC&#8217;s loss at Washington and Cal&#8217;s absolute collapse at Oregon.  Cal will be home this time, not that that has bothered USC in the recent past, but QB Matt Barkley will be back in action for the Trojans following a mediocre performance in a 27-6 win over Washington State last week.  I&#8217;m not sold on this USC team as anything reminiscent of their teams of the last decade, but I swore last week I would never bet Cal again after that joke of a performance.  Take a peek at NFL safey Taylor Mays wearing number 2 for USC, as well as NFL prospects at RB Joe McKnight for USC and Jahvid Best for Cal.  Also, this game is the home of Todd McShay&#8217;s &#8220;NFL Prospect Matchup of the Week&#8221; between USC potential first rounder LT Charles Brown vs. Cal mid-round prospect Tyson Alualu, should be a fun one to watch.  <strong>USC, -4.</strong></p>
<p>LSU +3.5 at Georgia</p>
<p>What does it say when the number 4 team in the country is getting 3.5 points in a matchup with the 18th ranked squad?  Well, a few things.  First, it means the number 18 team in the country isn&#8217;t half bad, in Georgia, but it also means there are some serious questions about LSU.  The Bayou Bengals barely snuck by Mississippi State, yes Mississippi State, last week, and have generally looked unimpressive all season though they have yet to lose, whereas the Dawgs have somehow gone 3-1 against a very tough schedule while sporting a minus-9 turnover ratio.  Does that mean that UGA is just waiting to break out if they can control their turnovers, or does it mean they are simply lucky and turnover prone?  Little bit of both, I say, but Georgia&#8217;s ranking is probably closer to their true ability than LSU&#8217;s, and they&#8217;re at home.  Keep an eye on LSU WR Brandon LaFell, the number 14 draft prospect in the country.  Despite him, I like Georgia to pull off this &#8220;mini-upset&#8221; in my heart, but 3.5 points is a half point too many for me to take the Dawgs vs. the spread.  Call it 30-28 Georgia, and therefore <strong>LSU, +3.5 </strong>is the &#8220;safe&#8221; pick.</p>
<p>Michigan +3.5 at Michigan State</p>
<p>What a sneaky wiseguy line this is!  Opened at Blue minus-1.5, and has now shifted to the green side of the state at a whopping minus-3.5!  Vegas insiders have been all over the Spartans on this one, but I say it&#8217;s gone too far.  Even if Michigan loses this game it won&#8217;t be by more than a field goal.  Plus, with QB Kirk Cousins at the helm, I have ZERO faith &#8211; seriously, <a title="start at the 9:15 mark" href="http://video.google.com/videosearch?source=ig&amp;hl=en&amp;rlz=&amp;=&amp;q=kirk%20cousins%20interception%20notre%20dame&amp;um=1&amp;ie=UTF-8&amp;sa=N&amp;tab=wv#" target="_blank">start at the 9:15 mark</a>, just trust me &#8211; in MSU driving with the ball late and close.  Also, peep Michigan DE Brandon Graham, a pro prospect on an otherwise dismal defense.  Call it another Crazy Tate finish for the <strong>WOLVERINES, +3.5</strong>.</p>
<p>Auburn +2.5 at Tennessee</p>
<p>Well, here&#8217;s another Lane Kiffin game.  As I wrote about a few weeks ago, Kiffin for some reason opted to play not to win against the Gators in his big grudge match, but we will assume he has to play to win vs. another former SEC powerhouse turned powderpuff in the Auburn Tigers.  Speaking of the Tigers, make sure you look closely because if you don&#8217;t you may confuse them with some sort of Pac-10 also-ran instead of an SEC team what with their no-huddle, spread offense and sieve-like d.  I say all-world Safety Eric Berry, my top player in all the land and Todd McShay&#8217;s number 4 overall prospect, slows down that offense a bit, but I&#8217;m just not sure if Jonathan Crompton is capable of leading any team to victory against a Div 1 defense.  Fortunately, Auburn&#8217;s defense may not be D-1 at this point so the hated Vols can ride freshman sensation RB Bryce Brown and stud RB Montario Hardesty to a close win and cover, <strong>TENNESSEE, -2.5.</strong></p>

			<content:encoded><![CDATA[<p>And here we go!  It&#8217;s the first week of College Football picks on The B Flow!!!  Every Thursday we&#8217;ll break down the five biggest matchups of the week &#8211; as determined by us, with an admitted SEC slant &#8211; and give you picks against the spread.  Picking NCAA Football straight up is a little too flattering, IMO, and leads to people like Chris Low, ESPN SEC Blogger extraordinaire, going 22-5 thanks to a lot of &#8220;I&#8217;ll take Alabama over North Texas, and Florida over Troy,&#8221; so we&#8217;re going spread!  Many folks opt to follow either College Football OR the NFL, but I think this is a big mistake.  While I could care less about my old alma mater&#8217;s gridiron exploits (homecoming this weekend vs. Howard!) or pretty much 90% of the college games, I DO care about the elite teams because you&#8217;re looking at the next NFL stars blossom in front of your eyes.  You also see passion&#8230;forget it, I&#8217;m not going to give you the Rah Rah College Football is better speech, I&#8217;ll leave that to the crazies.  Fact is, it&#8217;s football, and for the next 2 months it&#8217;s the only football we get on Saturdays, and it&#8217;s damned good, so deal with it.  In the future we will offer less analysis per game, and add in a segment on &#8220;Future Pros to Watch&#8221; to guide you through the games, but the season is just revving up so I don&#8217;t want to have you watching Mel Kiper&#8217;s all-overrated team at this point.</p>

<p><strong>Game of the Week</strong>:</p>
<p>Miami -2.5 at Virginia Tech</p>
<p>As much as it pains me to select a non-SEC game as game of the week, this is the best matchup this weekend.  I really like this Miami team &#8211; along with everyone else at this point &#8211; and would love to see Miami return to the elite of College Football.  Doesn&#8217;t it just seem like they belong there?  I miss random NFL studio idiots yelling about &#8220;The U,&#8221; and NFL coaches getting pissed off because their Miami-based players go to train at &#8220;The U&#8221; during the offseason instead of with the team because the trainers and facilities are better down there.  It&#8217;s fun.  Virginia Tech, on the other hand, is everything Miami is not.  They aren&#8217;t flashy, they haven&#8217;t had huge recruiting classes, they aren&#8217;t particularly good at offense, and they win on random special teams plays.  At least until this year.  The bottom line in this one is that Miami has passed two stern tests so far (Florida State and Georgia Tech), whereas Frank Beamer&#8217;s team has largely no-showed on two tests of their own (trampled by Alabama, unbelievably lucky to escape home vs. Nebraska last week).  Are the Hokies due for a good showing here?  Maybe, but I&#8217;m not convinced that it will even matter.  <strong>MIAMI, -2.5.</strong></p>

<p>Ole Miss -4 at South Carolina</p>
<p>The first real test for this season&#8217;s media darling, a trip to Columbia, SC should give us some idea of whether the Rebels can match the hype.  Famously the only team to beat Florida last season, Mississippi perhaps not-so-famously lost some significant talent &#8211; especially along both lines &#8211; to the NFL, including 1st Rounders DT Peria Jerry and OT Michael Oher.  Stud DE Greg Hardy is supposedly healthy for this matchup (for once), so he should disrupt Garcia enough in the backfield early (i.e. before he gets hurt again) for Jevan Snead and co. to overcome the early nerves on offense and move the football against an inferior opponent.  Look, the southeastern USC is not a bad team, but they gave up 52 points to Georgia, and are only 1-7 vs. the top 10 since Spurrier took over to rebuild the program.  There are NFL players abound to watch here, and most of them will be wearing the red, white, and blue.  <strong>OLE MISS, -4.</strong></p>
<p>California -5 at Oregon</p>
<p>Cal has got themselves aligned to finally wrest the Pac-10 from USC&#8217;s vice-like, 7-year grip, but the journey starts here with a tough road game at Autzen Stadium.  Objectively one of the loudest places to play in the country, this will be no cakewalk for the Golden Bears, especially early when the crowd is still in it.  In a cute side story, Oregon Coach Kelly actually refunded a fan $349 for tickets to Oregon&#8217;s disappointing defeat to Boise State earlier this season.  Classy move, but it may have set a troubling precedent for the rest of the season.  Get your Jahvid Best glasses on, because he will run wild.  <strong>CAL, -5.</strong></p>
<p>Iowa +10 at Penn St.</p>
<p>I seriously considered boycotting picking any Big 10 games all season just because I can&#8217;t stand the conference, but it is getting to the point nationally where I don&#8217;t need to be so belligerent anymore: the country agrees.  One might argue that part of the problem is that the conference&#8217;s standard bearer recently has been, almost exclusively, the Ohio State Buckeyes, a talented group exceptional at dominating fellow midwesterners, but abysmal at competing with other conferences&#8217; elite.  Perhaps it is finally time for Penn St. to break that mold.  They have to start here vs. a game Iowa team with sleeper Big 10 title hopes of it&#8217;s own.  Remember, Iowa was the only thing standing between Penn St. and an unbeaten regular season last year and the Nittany Lions couldn&#8217;t get it done.  Payback, as they say, can be a bitch.  <strong>PENN STATE, -10.</strong></p>
<p>Arkansas +17.5 at Alabama</p>
<p>This may not be the actual 5th best game of the week (perhaps it&#8217;s Georgia Tech-North Carolina, Georgia-Arizona State, LSU-Mississippi State, or even Florida State-South Florida), but as an Alabama fan I make the rules and as long as the Tide are unbeaten their game is important because it&#8217;s the next step on the march to the national title.  So there.  In all seriousness, though, you&#8217;ll want to tune into this one at 3:30pm on CBS to watch Michigan-transfer Ryan Mallet, who many are calling the best pro prospect in the SEC at the quarterback position (seriously, <a title="Corey Chavous says so" href="http://hogblog.nwaonline.net/2009/09/22/mallett-considered-the-secs-best-nfl-qb-prospect/" target="_blank">Corey Chavous says so</a>), against one of the elite defenses in the country in Alabama&#8217;s.  You&#8217;ll get the standard litany of NFL-caliber talent in the Crimson Tide lineup, pay particular attention to Junior LB sensation Rolando McClain, Junior CB/Return Man Javier Arenas, Senior beefcake Terrance Cody, Super Sophomores DL Marcel Dareus, LB Dont&#8217;a Hightower, WR Julio Jones, RB Mark Ingram, standout Freshman RB Trent Richardson, and the big uglies all along Alabama&#8217;s offensive front.  Every one of those gentlemen has a real chance to be an NFL difference maker.  Still, 17.5 points is a lot of points against a team with a big quarterback easily capable of putting up garbage scores.  I&#8217;ll say Arkansas keeps this closer than some think before Alabama pulls away for the 10-13 point win.  <strong>ARKANSAS, +17.5.</strong></p>

			<content:encoded><![CDATA[<p>1) I am FIRED UP about the potential for the SEC West showdowns this season.  Granted Georgia did a nice job in a shootout at Arkansas tonight (and that is a good thing for the competitive hope for my upcoming trip to the Cocktail Party this season), but the real heavyweights, i.e. Alabama, LSU, and Ole Miss really seem to be gaining momentum for a reckoning for the right to play Florida in Atlanta.  This is good stuff.<span id="more-23"></span></p>
<p>2) Pac-10?  2nd best conference in the country.  Good showing today from Cal, Washington, Oregon, UCLA, and even a nice showing from Stanford and Arizona State this week.  Top to bottom, I&#8217;ll take this conference over the Big 12 and ACC.  I think the SEC may be a little bit down &#8211; opposite of the last few years where they were incredible deep top to bottom but soft at the top, this year&#8217;s conference is top-heavy with Florida, Alabama, Mississippi and LSU, but lacking much depth beyond solid squads in Georgia, Auburn, Arkansas, South Carolina and Tennessee.  Wait a minute &#8211; that&#8217;s a deep conference!  Bottom line: if you&#8217;re in the SEC or Big 12 and go unbeaten, you play for the title.  If you&#8217;re in the Pac-10 and go unbeaten, you should be able to play for the title.  If you&#8217;re in the Big 10, ACC, Mountain West, or Big East (yes, in that order) and go unbeaten, well, you need a little help.</p>
<p>3) I have had enough of Tim Tebow&#8217;s &#8216;roid rage psyche up speeches.  Seriously, Tim, calm down.  There is inspiration and there is a group of phenomenal athletes quizzically looking at a maniac having a seizure before a game.  Fact: the Florida defense is a RIDICULOUS unit returning all 11 starters from a national championship side.  Fact: That defense is the unit that is going to carry Florida to a repeat, or not.  If today&#8217;s game vs. Tennessee proved anything, it proved that a talented, elite defense can&#8217;t necessarily stop Tebow and Florida, but it can contain them in the 20-30 point range.  At that point, it&#8217;s up to the offense of the opponent to win the game.  Clearly, Jonathan Crompton and Tennessee weren&#8217;t close to capable of doing that.  Alabama and Texas are.  Maybe a few other teams as well.</p>
<p>4) Another few reactions from the Florida-Tennessee &#8220;grudge match.&#8221;  First, Eric Berry is by so far and away the best player in the country it&#8217;s ridiculous.  He handled Tebow one-on-one every time he could have, and if that isn&#8217;t evidence that Tebow won&#8217;t work in the NFL, well, you&#8217;re just silly.  He has a windup reminiscent of B-Flow favorite the Pocket Amoeba, but adds mobility and toughness to that equation.  He&#8217;s a nice player, but he&#8217;s not quick enough or athletic enough to win battles with NFL linebackers, and NFL linebackers are just as big as he is, unlike those of the second tier SEC squads.  Second, I&#8217;m not sure whether to applaud Lane Kiffin for keeping his team in the game throughout, or to lambast him for clearly playing not to win, but to keep it close?  How else can we explain a coach that calls this drive, late in the 4th quarter down 10 &#8211; you tell me:</p>
